2. DMCA Takedown Notice Requirements

Your notice must include the following elements, as required by the DMCA:

  • Your full legal name and contact information
  • Identification of the copyrighted work(s) you believe have been infringed
  • The exact URL(s) or description of the material you claim is infringing
  • A statement that you have a good faith belief the use is unauthorized
  • A statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

3. Repeat Infringer Policy

SwishVPN may, at its discretion, terminate the accounts of repeat infringers. Our platform does not host user-generated content, but we respect all copyright claims made in good faith.

4. Counter-Notification Procedure

If you believe content was removed in error or as a result of misidentification, you may submit a counter-notice to our DMCA Agent. Your counter-notice must include:

  • Your name, address, and signature
  • Identification of the content and its original location
  • A statement under penalty of perjury that the content was removed in error or misidentification
  • A statement that you consent to the jurisdiction of the U.S. Federal District Court for your judicial district, or if outside the U.S., to a court in Kentucky, and that you accept service of process from the original complaining party

Upon receiving a valid counter-notice, we may restore the content unless the original claimant files legal action within 10 business days.
